UNINVESTIGATED ALLEGATIONS KNOWN TO MINISTER DEL AGUA SINCE JULY 2005 AND TO ATTORNEY GENERAL SINCE JULY 2006

In a press release issued last night by the GSLP over the allegations concerning the Doctor Giraldi Home in relation to the case of unfair dismissal brought by Joanna Hernandez, it is revealed that these allegations, which until now have gone un-investigated by the Royal Gibraltar Police, have been known to Minister Yvette del Agua since July 2005 and to the Attorney General since July 2006.

The GSLP says that allegations reported by the Social Services Agency to the RGP in July 2005, which the RGP say were investigated at the time, are not the same allegations as those contained in the bundle of documents that would have been made public if the unfair dismissal case had gone ahead in the Tribunal. These subsequent allegations, says the party, have been in the possession of the Social Services Agency since July 2005 and in the files of the Attorney General's Chambers since July 2006. Both the Minister and the Attorney General have therefore known of the allegations and done nothing about them. This is scandalous!

The following are only some of the allegations contained in that dossier which, to date, have not been investigated by the RGP:

A service user left alone at night by a support worker who went out, thereby placing the user at serious risk.

A female friend of a male employee, herself not an employee, being allowed into a flat whilst the employee was caring for a service user.

An employee coming into a service user flat, apparently drunk, displaying aggressive behaviour, and staying there to sleep. It is alleged that a service user was dragged out of her bed so that the employee could sleep in it. It is also alleged that prohibited drugs were got rid off by flushing down the toilet.

Instances of money going missing and being unaccounted for.

Instances of the wrong medicine being administered to service users.

An instance of the wrong medicine being administered, with the service user in question falling to the floor, sustaining injuries and requiring medical attention.

Drugs intended for patients going missing and being unaccounted for.
The whole of Gibraltar must surely be shocked that people have come forward and made these allegations concerning the care of disabled persons by the Social Services Agency, and that two and three years later, neither the Minister responsible at the time, Yvette del Agua nor the Attorney General, Ricky Rhoda, should have deemed it necessary to call in the police to investigate them.

The Government, through the Social Services Agency, has the responsibility of caring for this most vulnerable group of people in our society, people who cannot defend themselves, and they are not meeting their obligations to them by trying to sweep all this under the carpet. The Attorney General must clearly have seen that the allegations made include serious breaches of the law and that he is obliged to have these investigated. Gibraltar demands to know why none of this has happened and whether these serious allegations will now be thoroughly investigated. We have to get to the bottom of this once and for all and if it means that heads must roll then so be it.

We want to be able to go to bed at night re-assured that this most vulnerable group of people in our society is being well cared for.
