The Gibraltar Local Disability Movement and some of thefamilies of residents of the Dr Giraldi Home will like the files on Joanna Hernandez dismissal case, on the allegations concerning the Dr Giraldi Home to be made public.

After years of uncertainties the time is closer and an end to this nightmare on these subsequent allegations must be seen to end, if not for the serious effects its has on people who are closely related to the residents of the Dr Giraldi Home.

On the Attorney General’s Chambers since July 2006 as a result of the Joanna Hernandez unfair dismissal we have files that may put this issue to its end, and therefore the Gibraltar Local Disability Movement and families will like to see the files made public.

If the following are only some of the allegations contained in the documents we have a right to know, as we have love ones interest at heart, a family member told the GLDM.
A service user left alone at night by a support worker who went out, thereby placing the user at serious risk.
A female friend of a male employee, herself not an employee, being allowed into a flat whilst the employee was caring for a service user.
An employee coming into a service user flat, apparently drunk, displaying aggressive behaviour, and staying there to sleep. It is alleged that a service user was dragged out of her bed so that the employee could sleep in it. It is also alleged that prohibited drugs were got rid off by flushing down the toilet.
Instances of money going missing and being unaccounted for.
Instances of the wrong medicine being administered to service users.
An instance of the wrong medicine being administered, with the service user in question falling to the floor, sustaining injuries and requiring medical attention.
Drugs intended for patients going missing and being unaccounted for.
The GLDM will also like to note that the RGP may have found no evidence that will call for an investigation, but we ask if the subpoenaed had give evidence at the Tribunal hearing, where one of the agency staff would had provided details of a sexual "threesome" that may have taken place in a compartment of the train taking the pilgrims toLourdes,and also if evidence under oath of the sexual abuse by a staff member of at least one woman in the Agency's care, as well as physical and verbal abuse and punishments of others, Would this have warrant a full investigation.


The Gibraltar Local Disability Movement has been keeping logs of all statements, which have been mentioned in press reports and by studying the readings it has come to the following conciliation.

Suspicion and unsubstantiated proof only brings doubt, and we all believe in the system that of a rule that is recognized by the community laws, enforcement by established process in the law must be seen as free from the government authority and independent.

By studying all the readings, statements made by the Opposition and PDP and others, we see a content that are overwhelming to an independent thinker.


When you have by the opposition where it make notes that the allegations has not been properly investigated to the satisfaction of the public, and that it lends weight to its contention that this is a cover-up on the part of the Government,

And also if we make note of the PDP by Keith Azzopardi where he adds, (quote) it is correct to say that the judgment of whether the Government customarily acts in the public interest cannot depend on this case. But the public are entitled to the view that the way the Government has run this matter has not been in the public interest. Its continued resistance to a proper public enquiry of matters raised or to respond to questions of cost is further proof of that. (Unquote)

We also must not forget a former Team Leader, Duncan S. Jones BA (Hons.), MSc., Dip. In Law, CQSW, Cert. in Management (CMI), Cert. in TESOL of the Adult Services, Social Services Agency, and someone that held overall management responsibility for the Social Work Service for Adults, the Probation Service and the Day and Residential Services for People with Disabilities, Including the Dr. Giraldi Home, until he resigned from this post in January 2004. Where he writes in the press.

I am writing regarding the Press Release issued by the Government of Gibraltar, Ministry of Family, Youth and Community Affairs, dated 12 December 2007 (No. 175/2007), specifically the third paragraph of this statement, in which the following is stated:-

“The Social Services Agency repeats, yet again, that it has always acted swiftly and responsibly whenever allegations of neglect or abuse have been made. All cases have been properly investigated…”

This statement is untrue and the public have the right to know this.

Also many others have come out, all with the same view that there is a resistance to a proper public enquiry to the allegations concerning the Dr Giraldi Home.

The Gibraltar Local Disability Movement and some of thefamilies of residents of the Dr Giraldi Home are finding it difficult to, after years of uncertainties to have closer and an end to this nightmare on these subsequent allegations being made, and wish that the files of the Attorney General’s Chambers be made public. But the GLDM knows that this request will not be fore coming, and thus the GLDM has decided that it will start a Petition, requesting Government, Attorney General’s Chambers, Governor, and RGP to come out, and to try to make closer of the allegations concerning the Dr Giraldi Home


The GLDM adds that under the UN Universal Declaration of Human Rights reprehensive of Gibraltar authority has a duty to protect all of its community and not just a few.


The GLDM make note the UN Universal Declaration of Human Rights,
Article 3.Everyone has the right to life, liberty and security of person

Article 5.No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.


Art 1. Human Dignity
Human Dignity is inviolable. It must be respected and protected

The GLDM also make note to the powers and duties of Governor under the Gibraltar Constitution.

CHAPTER V
THE PUBLIC SERVICE, INCLUDING JUDICIAL AND SPECIFIED
APPOINTMENTS
Public service

(2) Subject to this Constitution, the Governor, acting in accordance with the advice of the Public Service Commission, may, in Her Majesty’s name and on Her Majesty’s behalf
(b) Exercise disciplinary control over public officers;

Governor to be kept informed
52. The Governor and the Chief Minister shall confer on a regular basis and the
Chief Minister shall brief and keep the Governor informed about the policies of the Government and the public affairs of Gibraltar.

The Governor must see that our government is in compliance of the UN Universal Declaration of Human Rights and we ask ourselves if the Governor and the Chief Minister conferred over the allegations concerning the Dr Giraldi Home.


The GLDM ends by expressing that until a full and proper public enquiry is done, no family member and even some of the public will be confident that no misconduct has taken place.
